1. Introduction

These Terms & Conditions govern the provision of photography services by [Your Business Name] (“the Photographer”, “we”, “us”, “our”) to nurseries, early years settings, parents and guardians.

By booking or purchasing photography services, you agree to the following terms.

2. Booking & Agreement with Nurseries

Photography sessions are arranged directly with the nursery or early years setting under a separate service agreement.

The nursery is responsible for:

Obtaining appropriate parental consent

Ensuring children are permitted to be photographed

Providing accurate class/group information where required

We reserve the right to refuse photography of any child where appropriate consent has not been obtained.

3. Parental Consent

No child will be photographed without consent provided by a parent or legal guardian through the nursery’s established consent process.

Parents may withdraw consent at any time by contacting: [Your Email Address]

Withdrawal of consent will apply to future processing and does not affect completed orders.

4. Image Editing & Use of Technology (Including AI)

All photographs are professionally edited to ensure high quality and consistency.

Editing may include:

Exposure and colour correction

Cropping and alignment

Background refinement

Minor retouching

We may use industry-standard software and secure cloud-based processing tools, including AI-assisted editing technology, strictly for enhancement purposes.

Images are:

Processed solely to deliver the photography service

Not used for advertising without separate explicit consent

Not sold, licensed, or shared for third-party marketing

Not used for AI model training by us

Any third-party service providers used act as data processors and are required to comply with UK GDPR and implement appropriate security safeguards.

5. Data Protection & GDPR Compliance

We are committed to protecting children’s personal data and operate in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

5.1 What Data We Process

Photographic images

Child’s first name (if required for ordering)

Parent contact details (where provided for order fulfilment)

5.2 Lawful Basis for Processing

Processing is based on:

Parental consent

Contractual necessity (fulfilment of photography orders)

5.3 Data Security

Images are:

Stored securely

Accessible only to authorised personnel

Protected using password-protected systems and secure platforms

5.4 Data Retention

Unless otherwise agreed:

Unordered images are retained for up to 12 months

Ordered images may be retained for accounting and record purposes for up to 6 years (as required by UK tax law)

Images are securely deleted after retention periods expire.

6. Proofing & Orders

Proofs are provided via secure online gallery or printed proof system.

Parents are responsible for:

Reviewing images within the ordering window

Ensuring order details are correct at time of submission

Orders cannot be amended once submitted to print.

7. Payments

All orders must be paid in full prior to production unless otherwise agreed.

We reserve the right to:

Cancel unpaid orders

Refuse service where payment disputes arise

8. Refunds & Reprints

Due to the personalised nature of photography products, refunds are not provided unless:

Products are faulty

An error has been made in printing or production

Claims must be made within 7 days of receipt.

9. Use of Images for Marketing

We will never use a child’s photograph for:

Website display

Social media

Promotional materials

without separate, explicit, written parental consent.

Where consent is granted, it may be withdrawn at any time.

10. Limitation of Liability

While every care is taken in capturing and processing images:

We cannot guarantee specific poses, expressions, or cooperation from young children.

In the unlikely event of equipment failure, data loss, or circumstances beyond our control, liability is limited to a refund of fees paid.

11. Nursery Responsibilities

The nursery agrees to:

Confirm appropriate parental consent

Provide suitable space and time allocation

Ensure children are supervised at all times

We are not responsible for behaviour, preparation, or clothing of children during sessions.

12. Intellectual Property

All images remain the copyright of [Your Business Name] under the Copyright, Designs and Patents Act 1988.

Purchased images are licensed to parents for:

Personal use

Printing and sharing with family

Images may not be:

Sold

Entered into commercial competitions

Used for business purposes

without written permission.
